This sweepstakes (the “Event”) is governed by these official rules (“Official Rules”).
The sponsor of this Event is Proxima Beta Pte. Limited, a Singapore corporation with its registered office at 10 Anson Road #21-07 International Plaza, Singapore (“Sponsor”), the publisher of Undawn (the “Game”).
2.Event Period. This Event begins at [06:00 Pacific Time Zone on August 13, 2021 and ends at 05:59 Pacific Time Zone on September 2, 2021] (the “Event Period”).
3.How to Enter. To participate in the Event, participants need to visit the Game Closed Beta Testing Recruitment Website, register and complete all requested information during the Event Period. One entry per individual. Multiple participants are not permitted to share the same email or other account needed for participation. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email or addresses, accounts, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Each potential winner may be required to show proof of being the authorized account holder.
In the event of a dispute as to any entrant, the authorized holder will be deemed to be the entrant. The “authorized holder” is the natural person assigned an account, email address or user ID by an Internet access provider, online service provider, Sponsor or other organization responsible for assigning accounts, email addresses or user names. Each potential winner may be required to show proof of being the authorized holder. Sponsor will make final determination of identity of participants and timing of entries in its sole discretion.
4.Eligibility. To enter the Event, participants must be a legal resident of Canada (excluding Quebec). In order to be eligible, participants must be at least the age of majority in their jurisdiction of residence. This Event is void in any states, provinces, jurisdictions, or territories where prohibited by law. Employees of Sponsor and its parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible.
5.How to Win. Sponsor will select the winners at random from among all the eligible participants at the end of the Event. In order to win, winners must first correctly answer a mathematical skill-testing question.
6.Prizes. 200 winners will receive a US$50 Amazon.com gift card. The approximate retail value (ARV) of the prize is US$50.
No substitution, assignment or transfer of the prize is permitted, except by Sponsor, who has the right to substitute a prize with another of comparable or greater value. The winner will receive the prize as set forth above provided that the winner meets the eligibility and other requirements under these Rules. The winner is responsible for any and all taxes and fees associated with the receipt and/or use of a prize.
7.Winner. Sponsor may attempt to notify winners by email, mail at the address associated with the winner’s entry form, and/or by other means consistent with the Event. Sponsor may contact the winner in a language prominent in the country of entry of the winner, or English. Sponsor is not responsible for any delay or failure to receive or understand notification for any reason, including inactive account(s), technical difficulties associated therewith, or winner’s failure to adequately monitor any account. The winner must then respond to Sponsor within [ninety-six (96) hours], including answering the mathematical skill-testing question, without assistance of any kind. Should the winner fail to respond to Sponsor, Sponsor reserves the right to disqualify that winner and select a new one in a second-chance random drawing. Winner may be required to sign an affidavit of eligibility, liability release and a publicity release. Winner may also be required to show proof of being the authorized account holder and may be required to provide full name, date of birth, country of citizenship, contact email/phone and other information in order to verify the winner.
By entering this Event or accepting any prize, each participant (including without limitation each honorable mention) allows Sponsor to use their name, photograph, likeness, voice, opinions, information, biographical information, hometown and jurisdiction of residence for publicity and promotional purposes without further compensation where permitted by law. Except where prohibited, participation in the Event constitutes participant’s consent to Sponsor’s use of participant’s name, likeness, voice, opinions, biographical information, hometown and jurisdiction of residence for promotional purposes in any media without further payment or consideration.
8.List of Winner(s). Individuals may request the name of the winner by submitting a self-addressed stamped envelope prior to 3 months from the end date to Proxima Beta Pte. Limited, Attn. Undawn Closed Beta Recruitment Sweepstakes, 10 Anson Road #21-07 International Plaza, Singapore.
9.Conditions of Participation. By participating this Event, you agree to abide by these Official Rules, the UNDAWN EULA, the UNDAWN (Closed Beta Testing) Recruitment Website Privacy Policy and any decision Sponsor makes regarding this Event, which Sponsor shall make in its sole discretion. CAUTION AND WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE THE EVENT OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS EVENT MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
10.DISCLAIMER, RELEASE AND LIMIT OF LIABILITY. SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE PROMOTION. BY ENTERING THE PROMOTION OR RECEIPT OF ANY PRIZE, EACH PARTICIPANT AGREES TO RELEASE AND HOLD HARMLESS SPONSOR, ANY THIRD-PARTY SOCIAL MEDIA CHANNELS AND EACH OF THEIR SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS, AND EACH OF THEIR RESPECTIVE PARENT COMPANIES AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING OUT OF PARTICIPATION IN THE PROMOTION OR RECEIPT OR USE OR MISUSE OF ANY PRIZE. 11.Privacy and Use of Promotion Information. Information collected from participants is subject to the UNDAWN (Closed Beta Testing) Recruitment Website Privacy Policy.
12.Governing Law and Disputes. These Official Rules will be interpreted, construed, and enforced in all respects in accordance with the laws of Singapore without reference to its choice of law rules and not including the provisions of the 1980 U.N. Convention on Contracts for the International Sale of Goods. Except for the right of either party to apply to any court of competent jurisdiction for a temporary restraining order, a preliminary injunction, or other equitable relief to preserve the status quo or prevent irreparable harm, any dispute as to the interpretation, enforcement, breach, or termination of these Official Rules will be settled by binding arbitration before three (3) arbitrators under the auspices of administered by the Singapore International Arbitration Centre (SIAC) in Singapore under the UNCITRAL Arbitration Rule. The arbitration tribunal will consist of three arbitrators to be appointed in accordance with the Rules, which Rules are deemed to be incorporated by reference into this clause and as may be amended by the rest of this clause. The seat of arbitration will be Singapore or any other place on which the parties mutually agree. Judgment upon the award rendered by the arbitration tribunal may be entered in any court of competent jurisdiction. The prevailing party will note be entitled to receive from the other party its attorneys’ fees and costs incurred in connection with any arbitration or litigation instituted in connection with this Agreement.
The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind these Official Rules or seek injunctive or any other equitable relief.
This arbitration clause constitutes a waiver of each participant’s right to a jury trial for all disputes relating to all aspects of the Event and these Official Rules, including, but not limited to, the following claims: (a) claims, both express and implied, for breach of contract, breach of the covenant of good faith and fair dealing, negligent or intentional infliction of emotional distress, negligent or intentional misrepresentation, negligent or intentional interference with contract or prospective economic advantage, and defamation; and (b) any and all claims for violation of any local laws or regulations.
Each party’s promise to resolve claims by arbitration in accordance with the provisions of these Official Rules, rather than through the courts, is consideration for the other party’s like promise.
13.No Affiliation with Social Media Channels. This Promotion is in no way sponsored, endorsed or administered by, or associated with, the any social media channels such as Facebook, Twitter and Instagram. You understand that you are providing your information to Sponsor and not to the social media channels. The information you provide will only be used as described in these Official Rules and Sponsor’s privacy policy.
